Engadget: AT&T issues official statement on SlingPlayer's 3G blackout for iPhone

One can only imagine the intense outpouring of hatred AT&T must have received from customers immediately following the announcement that the iPhone SlingPlayer will be not be able to stream video using AT&T's data network. While it hasn't exactly been declared by anyone that AT&T is to blame for the apparent lack of 3G support, they are the only one with something to gain by a Wi-Fi only SlingPlayer. It doesn't take much to come to this conclusion.

Our friends at Engadget have managed to squeeze a statement out of AT&T regarding the 3G blackout:

"Slingbox, which would use large amounts of wireless network capacity, could create congestion and potentially prevent other customers from using the network. The application does not run on our 3G wireless network. Applications like this, which redirect a TV signal to a personal computer, are specifically prohibited under our terms of service. We consider smartphones like the iPhone to be personal computers in that they have the same hardware and software attributes as PCs.

That said, we don't restrict users from going to a Web site that lets them view videos. But what our terms and conditions prohibit is the transferring, or slinging, of a TV signal to their personal computer or smartphone.

The Slingbox application for the iPhone runs on WiFi. That's good news for AT&T's iPhone 3G customers, who get free WiFi access at our 20,000 owned and operated hot spots in the U.S., including Starbucks, McDonalds, Barnes & Noble, hotels, and airports. AT&T is the industry leader in WiFi."

We're not surprised AT&T went straight to their Terms of Service as defense. We were highly suspect when they initially changed their lingo to outright ban placeshifting from their network. Sure, they "retracted it," but then added back a more generic version of their placeshifting restriction that (we thought) seemed intentionally vague. The reality: a lawyer told them a 'personal computer' could be interpreted as any mobile device with computing functions (that's all of them by the way). Why look bad by saying placeshifting is outright banned when you can look less bad by tossing out a BS generic line that's open to interpretation? Better yet, without clarity in their definition, they can enforce it with zero consistency.

Well, was waiting to buy an iphone when Slingplayer was available for it, but I guess I don't have to worry about that any more.......I'll just continue using my Tilt which streams very well. Screw at&t. I left Verizon when they started restricting how I use my phone, now it's time to leave at&t. What kind of services do they think they are offering?? phone service?? Phone service is a secondary feature of most cell phones today. WAKE UP! jerks....

Im with jeff58 and probably 100% of the rest of those who waited for what would easily have been the BEST APP TO DATE for the iPhone but has been crippled in features but not crippled in price. Blackberry SlingPlayerMobile (works with 3g), Windows Mobile SPM (works with 3g...I know...I have a Tilt as well) BUT NOT FOR iPHONE. Dear AT&T...more people own BlackBerry devices than iPhones...but the iphone traffic would be a problem? 50% of the Apps i own for my 1st gen iPhone stream continuously. MLB App, WunderRadio, even the Sesame Street Podcast one I have for my child. AND CORRECT ME IF IM WRONG but isnt there a Hulu App in the works? Need I complain more? We get the point... BOTTOM LINE...I have been waiting to finally buy an iPhone 3g and when SlingPlayer was released. I was when I was finally gonna upgrade to it from my current iPhone. NOT ANYMORE!!! And I got sucked into buying an HD box because it was ESSENTIAL for use with iPhone. I own 2 SlingBox AVs, 1 SlingBox HD and 2 Sling catchers. SCREW YOU AT&T. Apple...GROW A SET!!! AT&T needs you more than you need them. Sling...this is a disappointment. PLUS...SPM ISNT EVEN

I emailed AT&T customer service at icare3@amcustomercare.att-mail.com and received their response "AT&T is not equipped to filter or restrict certain types of internet access. The type of usage that would be active if a SlingBox iPhone application was streaming over our wireless network would severely impact network performance and reliability, impair network access for other users and violate our terms
of service. At this time there is no plan to change the 3G availability of Sling Media usage." I then filed a Deceptive or Unlawful Advertising or Marketing Complaint with the FCC at http://esupport.fcc.gov/complaints.htm Maybe just maybe if they get enough email or complaints from unhappy customers they might change their TOS again allowing 3G access.

I broke down and bought it today...works fine over 3g if your jailbroken and download VOIPover3G. Jailbreaking is the only way to go with these phones. the process is just too easy and opens too many new doors for functionality.

Maybe this is the reason, 1.5 million subscribers AT&T will acquire from Verizon Wireless will be switched to AT&T's GSM network.

Since slingers are forced to rely on wifi anyway, maybe if enough people were to drop the $30 a month data plan it would get AT&T's attention?

I did what you did, but I'm too skeer't to actually use it... wondering if anyone else has started slinging on jailbroken phones and if so... noticed any shaping, etc....

This is the e-mail I received from ATT Customer Care. Take a look at the second paragraph.... Anyone who believes that ATT is not responsible for the 3G ban on slingplayer, after reading this, has got to have their head examined.

your iPhone and why the same stance is not being taken with customers
with other devices using the same application. I truly apologize for
any inconvenience this has caused you. My name is Jenifer [R ],

At this time, AT&T is able to provide input to Apple regarding how
applications would impact our network usage. We do not currently have
this ability to provide such input for applications sold by third
parties for downloading directly onto other devices. Consequently, we
are currently only able to impact such usage with iPhones. Such
decisions are re-examined on a regular basis, and your feedback has been
forwarded.

Ridiculous.

I am moving back to the US in October and I will NOT be:

1. getting a contract with AT&T
2. getting an iphone
3. and, therefore, spending $30 on a crap phone application

I am also steaming because what right do AT&T have to dictate to Sling that this app can not support 3G. Believe it or not, iphones, Slingboxes, and 3G services are available outside the US. Insular, selfish and unjustifiable.

Searching the web about AT&T excuses to not allow 3G support for the slingplayer for iphone are not good for AT&T. I hope the FCC do something to resolve the issue. I'm paying for unlimited data service and I can't use my paid service with my slingplayer..

I concur with those commenters who have used the mobile slingplayer on other phones. I've been using it on my AT&T Tilt since the app was first available. What's REALLY going on? Where can I direct my displeasure with AT&T?

Interesting considering that AT&T wants to charge their custermers $15 a month to view television through their network and it seems that they are attempting the obtain a monopoly on this service. To me it show their greed and lack of concern for their customers, especially in these tough economic times. I think that the outright ban of slingbox signals or them telling their customers what they can and can not use their smart phones for is a serious mistake on their part.

Completely agree - a double-standard if I ever heard one...

I'm a proud AT&T Tilt user (patched to the WinMo6.1 release), and I stream my SlingBox happily. I was in a podunk POS airport the other day (COUGH kc COUGH backazzcountryidiots COUGH), and I'd forgotten my USB cable, so I had my Tilt functioning as my tethered modem via Bluetooth, and I was happily slinging to my laptop.

I'm not giving up $30 for the WiFi app - not worth that kind of money, a bit peeved that I laid out money on a new Solo from Sling just because of the damn player coming to iPhone, after 3.0 I'll jailbreak and MAYBE consider shelling out $30 for an app that will work on a jailbroken phone. Thanks AT$T for nothing! Whatever phone comes along that isn't AT&T controlled and has the cool of the iPhone, off to eBay my iPhone goes. Screw you AT&T - "The new AT&T" acts a lot like the old AT&T. Just waiting to hear Lily Tomlin chime in.

I guess I'll just wait until AT&T complains about my family's usage. Then I'll decide which other wireless provider to change to.

We have 5 cell phones 3 with PDA unlimited data. (Large bill $$$) None of us are heavy data or sling users, but when I want to set my Tivo using Slingbox or view my security cameras, I expect it to work on via 3G.

I have no desire for an iPhone, way to limited as far as applications, especially Slingbox.

Love my WM 6.1 phone! I've been very pleased with AT&T for about 10 years, but not enough to stay if I can't Sling when/where I want to.

Funniest thing is that France 24, the 24/7 news channel app streams on 3G just fine but Sling can't for at&t's terms of service reasons. They also won't let the Television app stream except on WiFi, showing lack of any consistency on those terms of service. The solution for all of this is easy: charge a 2nd tier for those wanting more data and raise the price say $20 a month for use of ALL data. There's NOTHING that can't be fixed with corporate America when cold, hard cash is thrown at it! I'd be happy going to a higher tier and paying for the extra data. By the way, we are just back from Europe and we Americans got it good...there they seem to charge for everything and not just a few bucks like we pay for all we get!

It is AT&T's network and Apple's phone, and both companies want to sell you TV streaming services, and since they control everything it is no surprise they don't allow it. Ever other carrier and phone company wants to be the one to sell you this. They don't care about WiFi because it doesn't represent a large community of TV viewers. If you can connect to Wifi, chances are you can probably watch the programming on your PC or a TV nearby anyway. Anyone using the network is likely on the go, and therefore the phone is the only place to watch. That is the service they want to sell you.

Apple's App Store has dramatically forced changed at Verizon and RIM. Forever Verizon controlled the app experience (remember "get it now" - quickly becoming a thing of the past) but is forced to open their phones and networks. This is the beginning of a trend that they want to avoid - being relegated to just a commodity "pipe" and giving all the glory, value, and revenue to the application companies and phone manufacturers.

Let's hope some other market force compells AT&T and iPhone to open up. I am betting Verizon will be a factor as they scramble to match or gain the lead against the iPhone.
